🧾 Terms and Conditions of Sale (CGV)

1. Scope of Application

These Terms and Conditions of Sale (“Terms”) apply to all orders placed through the website https://www.kaminholzz.com, operated by Breuer Handels- und Service GmbH, and form an integral part of every contract concluded between the company and its customers.

By placing an order on our website, you acknowledge and accept these Terms.

3. Products and Availability

Our products are described and presented with the greatest possible accuracy.
However, slight variations in color, size, or packaging may occur due to manufacturing or natural material differences.

Product availability is subject to change. In the event of unavailability after your order, you will be notified promptly and refunded if payment has already been made.

4. Orders

Placing an order on kaminholzz.com constitutes a binding offer to purchase.
Once received, you will receive an order confirmation by email, which serves as acceptance of your offer and concludes the sales contract.

We reserve the right to refuse an order in cases of:

  • Payment issues or fraudulent activity

  • Delivery address outside our service zones

  • Abnormal or bulk orders without prior agreement

5. Prices

All prices are indicated in euros (€) and include German VAT unless stated otherwise.
Prices do not include delivery costs, which are displayed separately before checkout.

We reserve the right to change prices at any time, but orders already confirmed will not be affected.

6. Payment Terms

Payments can be made using the following methods:

  • Bank transfer

  • Credit or debit card (Visa, Mastercard, etc.)

  • PayPal

Payment is due immediately upon order confirmation, unless otherwise specified.
The order will only be processed after full payment has been received.

In case of late payment or non-payment, Breuer Handels- und Service GmbH reserves the right to cancel or suspend the order.

7. Delivery

Orders are shipped to the delivery address provided by the customer.
Delivery times are indicated for reference only and may vary depending on stock and location.

Shipping and logistics are handled by approved partners.
Breuer Handels- und Service GmbH cannot be held responsible for delays due to circumstances beyond its control (e.g., transport strikes, extreme weather).

Ownership of the goods is transferred to the customer only after full payment has been received.

8. Right of Withdrawal (EU Consumers)

Under EU law (Directive 2011/83/EU), consumers have the right to withdraw from a purchase within 14 days of receiving the goods, without giving any reason.

Returned products must be:

  • Unused, in their original packaging

  • Shipped back at your expense within 14 days after notifying us

Upon receipt and inspection of the returned goods, we will issue a refund within 14 days using the same payment method used for the purchase.

Exceptions: the right of withdrawal does not apply to goods that are custom-cut, perishable, or damaged after delivery due to improper handling.

9. Warranty and Liability

All our products are covered by the legal warranty of conformity and the warranty against hidden defects as defined by EU and German law (§§ 434–435 BGB).

If a defect is found, you must notify us in writing within a reasonable time.
We will replace, repair, or refund the product as appropriate.

Breuer Handels- und Service GmbH shall not be held liable for:

  • Improper use of the product

  • Failure to follow storage or installation instructions

  • Normal wear and tear

10. Returns and Refunds

Before returning any goods, please contact our customer service at contact@kaminholzz.com to obtain a return authorization.
Unauthorized returns may not be processed.

Refunds will be made within 14 days after receiving and inspecting the returned items.

11. Force Majeure

The company shall not be held liable for failure to perform its obligations due to force majeure, including but not limited to natural disasters, war, strikes, supply shortages, or technical failures beyond its control.

12. Data Protection

Personal data collected during ordering or communication are processed in accordance with our Privacy Policy and applicable GDPR provisions.

13. Governing Law and Jurisdiction

These Terms are governed by German law.
In case of dispute, jurisdiction shall lie with the courts of Berlin, unless otherwise required by consumer protection law.
